For a B Khata property to be considered under the current conversion mechanism, these are the key conditions to check:

  1. Property size: The plot, site or land must generally measure 1,000 square metres or less. Properties above this limit are excluded.

  2. Permitted non-agricultural use: The property must already be used for the proposed non-agricultural purpose, and that use must be permissible under the applicable Master Plan, Zonal Regulations or other town-planning rules.

  3. B Khata cut-off date: For properties within urban local bodies, the B Khata must have been issued on or before September 10, 2024, subject to the other eligibility conditions. The order provides different cut-off rules for rural local bodies.

  4. Certain types of land are excluded: Government land, B-Kharab land, forest land, gomal land, tanks and tank beds, rajakaluves, nalas, roads, road margins and land reserved for public purposes are among the excluded categories.

  5. No disqualifying restrictions: Properties affected by acquisition proceedings, court or tribunal stays, government restrictions, or violations of applicable Master Plans, Zonal Regulations or land-use restrictions may not qualify for conversion.

These conditions show why B Khata does not automatically become A Khata simply because property tax has been paid. The property's records, land use and eligibility have to be checked before conversion can be considered.
