What Is a Legal Heir Certificate?
A legal heir certificate is a document that identifies the surviving family members or legal heirs of a person who has died. It is mainly used to establish the relationship between the deceased person and the surviving family members for a particular administrative or legal purpose.
In simple terms, if a person dies, an authority or institution may need to know who the surviving family members are. A legal heir certificate provides this family relationship information. For example, suppose a government employee dies leaving behind a spouse, one son and one daughter. A legal heir certificate can identify these surviving family members in relation to the deceased.

For Hindus dying without a Will, the Hindu Succession Act, 1956 sets out the order of succession. Its Class I list includes a son, daughter, widow and mother, along with certain descendants of pre-deceased children.

The Kannada term commonly used for a legal heir certificate is “ಕಾನೂನು ಉತ್ತರಾಧಿಕಾರಿ ಪ್ರಮಾಣಪತ್ರ” (Kaanoonu Uttaradhikaari Pramaanapatra). The Bengaluru Urban District government website uses this terminology for the service.
The key point is simple: a legal heir certificate identifies the legal heirs; it does not by itself settle every question about ownership or inheritance.
Why Is a Legal Heir Certificate Used After a Person's Death?
A legal heir certificate is used to establish who the surviving heirs of a deceased person are for purposes where such proof is accepted. Its use can arise in employment, government benefit and other administrative matters.
For example, Karnataka's government-employee compassionate appointment process asks for a Surviving Family Members Certificate among the documents that may be uploaded for an eligible deceased employee's family. The Karnataka applicant portal also asks for details such as the deceased employee's name, death date, applicant's relationship and nominee details.
The document can therefore become part of a larger set of records used to establish the deceased person's family relationships.
However, there is an important distinction for financial assets. A legal heir certificate should not automatically be treated as the same document as a succession certificate.
Under Section 372 of the Indian Succession Act, 1925, an application for a succession certificate is made to the District Judge and includes details about the deceased, their relatives, the applicant's claimed right, and the debts or securities for which the certificate is requested.
So, before using a legal heir certificate for a particular asset, check what the concerned bank, government department, employer or authority actually requires.

Who Does a Legal Heir Certificate Identify?
A legal heir certificate identifies the people who qualify as legal heirs based on the applicable law and the circumstances of the deceased person. The exact list cannot be decided by using one generic family checklist for every case.
For a Hindu person who dies intestate, the Hindu Succession Act provides an order of succession. Section 8 states that the property of a male Hindu dying intestate first goes to the Class I heirs listed in the Act; if there are no Class I heirs, the law moves to Class II heirs and then to other categories.
The Class I schedule includes:
Son
Daughter
Widow
Mother
Children of certain pre-deceased sons or daughters
Widows of certain pre-deceased sons
The complete legal position can be more detailed than this list. For example, the Act also contains provisions dealing with the branches of pre-deceased children.
Consider a simple example. A Hindu man dies without a Will and leaves behind his wife, son and daughter. These relationships are specifically included in Class I of the Hindu Succession Act.
That does not mean every legal heir certificate in India will contain the same names. The deceased person's religion, personal law, family structure, Will, previous deaths in the family and the purpose for which the certificate is required can affect the documents and legal process involved.
The safest approach is to establish the family relationship using records such as the death certificate and documents showing the relationship, rather than assuming that every relative automatically has the same legal status.
What Does a Legal Heir Certificate Mean in Karnataka?
In Karnataka, the current government position is different from the general India-wide descriptions found on many websites. The Bengaluru Urban District, Government of Karnataka states that a legal heir certificate is now issued only to the kin of deceased government servants. It further states that everyone else has to obtain a succession certificate through the jurisdictional civil court.
This distinction matters for families in Bengaluru.
For example, if the deceased person was a Karnataka government employee, the family may fall within the government process for establishing surviving family members. Karnataka's government portal for compassionate appointment also asks for specific information about the deceased employee and the applicant's relationship.
For a person who was not a government servant, you should not assume that the standard revenue-office legal heir certificate process described on older websites applies to your case.
The Bengaluru Urban District government page directs such applicants toward a succession certificate through the jurisdictional civil court. Under Section 371 of the Indian Succession Act, 1925, the District Judge having the relevant jurisdiction may grant a succession certificate.
This is why the deceased person's employment status should be checked before starting an application.
