What Clauses Should You Add to a Commercial Lease Agreement Format?

The important clauses are the ones that clearly define how the premises can be used, how money will be paid and what each party must do during and after the lease.

Parties and Property Details

Identify the lessor and lessee by their legal names. If a company is taking the premises, use the company's legal name and identify the person signing on its behalf.

How Do You Execute and Register a Commercial Lease Agreement?

A commercial lease should be checked against its term and other conditions before execution because registration requirements depend on the type of lease.

Section 17 of the Registration Act, 1908 makes registration compulsory for leases of immovable property from year to year, for a term exceeding one year, or reserving a yearly rent.

Section 107 of the Transfer of Property Act, 1882 similarly states that a lease from year to year, for a term exceeding one year, or reserving a yearly rent can be made only through a registered instrument.
