Everything you need to know about the financial power of attorney in property and real estate. Learn about the definition, legalities, types, and other aspects of POA.

Quick Summary: (TL; DR)

  • Definition: Financial power of attorney (POA) in property means that you assign some person to conduct your financial and legal business concerning property buying, deed transfers, bank transactions, and others.

  • No Right to Possess: The person who has POA has no right to own that property but acts as a property manager.

  • Most Efficient: Among all types of POAs, the most efficient type of POA is the durable POA since it will remain valid even if you fall ill.

  • Types of Indian POA: General, special, durable, and springing POA are some of the common varieties of POA in India.

  • Quick Registration: Using a pre-existing format and getting it duly registered at the sub-registrar office makes POA creation simple and straightforward.

What is a Financial POA in Property?

A Financial POA allows the appointed person to legally act on behalf of the property owner for financial and real estate matters.

For example, the agent may be authorised to:

  • Buy or sell property

  • Sign sale deeds and property agreements

  • Register documents before the Sub-Registrar

  • Apply for Khata transfer or mutation

  • Pay property tax and utility bills

  • Collect rent from tenants

  • Manage home loan or mortgage formalities

  • Open or operate bank accounts related to the property

  • Represent the owner before government authorities such as BBMP, BDA, BESCOM, or the Sub-Registrar Office

Example

Suppose Ravi works in the United States and owns an apartment in Bangalore. Since he cannot travel to India, he executes a Financial POA in favour of his father.

His father can then:

  • Complete the sale of the apartment

  • Sign the sale deed

  • Pay stamp duty and registration charges

  • Attend the Sub-Registrar Office

  • Receive the sale consideration (if authorised)

  • Complete the Khata transfer after registration

Key Point

A Financial Power of Attorney does not transfer ownership of the property. It only authorises another person to act on the owner's behalf. The principal remains the legal owner unless the property is transferred through a valid registered conveyance, such as a sale deed or gift deed.

What Is a Power of Attorney in Simple Words?

Simply put, a power of attorney refers to a legal authorization that authorizes banks, courts, and land registries to acknowledge that you "trust this person to act as your representative and endorse legal papers for you." In other words, the document authorizes your representative to operate on your behalf legally anytime you are absent.

What is power of attorney in terms of property?

In property dealings, POA is a legal agreement by which one individual assigns another individual the authority to manage property issues. The individual assigning POA powers is referred to as a principal, while the recipient of the POA is called an agent/attorney-in-fact.

When you own some property, such as houses and pieces of land, you can use a POA to give your agent the ability to engage in activities like:

  • Selling or buying real property in your name.

  • Executing lease contracts and receiving monthly rental income.

  • Managing your property tax payments and handling home insurance policy applications.

  • Applying for home mortgages or land registration.

What Is the Meaning of Financial Power?

Financial power refers to the actual authority to manage money, bank accounts, and other valuable assets in legal contracts and real estate agreements.

Financial power literally gives someone control over your finances. This person can sign on to your bank account online, make payments, withdraw cash, negotiate with creditors, and even buy and sell securities on your behalf. Regarding real estate, financial power allows your realtor to physically handle the financial aspects of your transaction, such as accepting a down payment or paying an owner.

What Are the Four Types of Power of Attorney in India?

In India, there are four main kinds of POA agreements recognized depending on the extent of powers granted:

1. General POA (GPA): It allows your agent full and sweeping power to handle all your finances, banking, and properties simultaneously.

2. Special POA (SPA): This POA is very restrictive in nature. It gives you power for one particular purpose, for instance, to sign the documents for the completion of the purchase of one particular house clone. Once the task is completed, SPA becomes invalid.

3. Durable POA: The usual POA becomes invalid if the principal person is severely ill or suffers loss of mental capacity. A Durable POA contains an additional provision that says that even if the principal becomes mentally incapacitated in any way, the POA remains in effect.

4. Springing/Medical POA: In this POA, the document comes into force when a particular situation arises, such as when the doctor declares that the principal is not mentally fit to take any decision.

What is the power of attorney type of ownership?

One of the most important sources of confusion is that there exists no such concept as the "Power of Attorney form of ownership."

The power of attorney is the delegation of management, not the delegation of ownership. It has been explicitly established by the Supreme Court of India that there can be no transfer of property through the instrument of a General Power of Attorney. Being in possession of a POA does not confer ownership rights or convey title of any sort.
