CBI vs Bengaluru Builders: What Every Homebuyer Must Check

CBI files 14th and 15th chargesheets against Ithaca Estate and LGCL Urban Homes in Bengaluru homebuyers fraud. How to verify a builder before you invest.

Quick Summary (TL; DR)

  • The CBI filed its 14th and 15th chargesheets on July 7, 2026, against Bengaluru-based builder companies Ithaca Estate Pvt Ltd and LGCL Urban Homes (India) LLP, along with their directors and officials of HDFC Bank, ICICI Bank, and Indiabulls Housing Finance, in connection with large-scale fraud against homebuyers

  • The accused allegedly induced homebuyers through false assurances and fraudulent representations, in conspiracy with bank officials, to obtain financial benefits through illegal and deceptive means. Chargesheets include offences relating to criminal conspiracy, cheating, criminal breach of trust and other applicable provisions under the law.

  • This is part of a wider Supreme Court-directed investigation  the CBI is currently investigating 34 additional cases against builder companies and bank officials across India, having already filed 15 chargesheets

  • The fraud pattern is consistent: builder promises delivery, buyers pay and take out home loans, EMIs run for years, and no construction happens, leaving buyers paying for homes that exist only on paper

  • Before booking any flat or villa in Bengaluru, every buyer must independently verify RERA registration, KRERA compliance status, builder's MCA records, and project-specific escrow compliance  none of which require a lawyer to check

The chargesheets cover two separate cases and name the following entities:

Case 1: Ithaca Estate Pvt Ltd: The company, its director, and officials of HDFC Bank Ltd, ICICI Bank Ltd, and Indiabulls Housing Finance Ltd are named.

Case 2: LGCL Urban Homes (India) LLP: The LLP and its director are named.

The CBI has filed chargesheets naming Bengaluru-based builder and developers Ithaca Estate Pvt Ltd and LGCL Urban Homes (India) LLP in connection with the ongoing investigation into alleged large-scale cheating of homebuyers.

The agency said it has gathered substantial evidence during the investigation and has filed the chargesheets under relevant provisions relating to criminal conspiracy, cheating, criminal breach of trust and offences relating to criminal conspiracy, cheating and criminal breach of trust.

The Bigger Picture: 15 Chargesheets and Counting

This is not an isolated case. It is part of a Supreme Court-directed investigation that has been running for over a year.

The CBI is currently investigating another 34 cases registered following directions issued by the Supreme Court against various builder companies and unknown officials of financial institutions across the country in connection with alleged cheating of homebuyers and diversion of funds.

Earlier, the agency had filed 13 chargesheets against several real estate firms, including Rudra Buildwell Constructions Pvt Ltd, Dream Procon Pvt Ltd, Jaypee Infratech Ltd, AVJ Developers (India) Pvt Ltd, CHD Developers Pvt Ltd, Sequel Buildcon Pvt Ltd, Logix City Developers Pvt Ltd, Manju J Homes India Ltd, Shubhkamna Buildtech Pvt Ltd, Ninex Developers Ltd, Decent Buildwell Pvt Ltd and Rudra Buildwell Projects Pvt Ltd, along with their directors and officials of various banks and financial institutions.

The CBI is investigating a nexus of builders and officials of major financial bodies on the directions of the Supreme Court after buyers of private homes approached the apex court after being cheated.

How the Fraud Typically Works: The Pattern Every Buyer Must Recognise

For homebuyers, the promises of developers have long evaporated. A Delhi-based software engineer booked a flat in Bengaluru in 2017 for ₹68 lakh. The builder assured delivery by 2021. Today, not a single brick has been laid. Yet every month, the bank deducts EMI for a house that exists only on paper.

The mechanism behind these cases follows a predictable pattern:

  • Builder launches a housing project, registers it under RERA, and begins collecting bookings

  • Buyers take home loans. Banks disburse funds to the builder  often in advance of construction progress

  • Builder diverts funds meant for the project to other uses, related entities, or private accounts

  • Construction stalls. Delivery dates pass. The builder makes repeated assurances

  • Buyers continue paying EMIs to banks for homes that will not be delivered

  • Eventually, builder insolvency or criminal proceedings reveal the extent of the diversion

The involvement of bank officials as named in the CBI chargesheet points to a deeper failure: loans were disbursed without adequate verification of project progress and construction milestones, which the 70% escrow rule under RERA is specifically designed to prevent.

Why Builder and Contractor Verification Matters Before Booking

The frauds in these chargesheets did not appear overnight. Warning signs were present and verifiable before booking. Every Bengaluru homebuyer can independently check the following before paying any booking amount:

1. KRERA Registration

All projects in Karnataka with more than 8 flats or a plot area exceeding 500 sq m must be RERA-registered. The CBI reiterated its commitment to ensuring accountability in cases involving economic offences, corruption and public fraud, particularly those affecting the interests of common citizens and homebuyers. Search the project at rera.karnataka.gov.in  check: registration number, registered completion date, quarterly progress reports, and whether the developer has updated these on schedule. A developer missing QPR submissions is a warning sign.

2. Ministry of Corporate Affairs (MCA) Company Check

Every builder that is a private limited company or LLP is registered with the Ministry of Corporate Affairs. At mca.gov.in, search the company by name. Check: date of incorporation, current status (Active, Struck Off, Under Liquidation), and whether annual returns and financial statements have been filed. A company that has not filed its annual returns for multiple years is a compliance red flag.

3. Builder's Track Record of Delivered Projects

Before booking, visit at least one completed project by the same builder. Speak to residents of that project  not the builder's sales team. Ask specifically: was possession given on time, was the OC obtained, and has the society's conveyance deed been executed? A builder with no completed project in their portfolio is a materially higher risk.

4. RERA Project Account and Escrow Compliance

Under RERA, 70% of project funds must be maintained in a designated escrow account and can only be withdrawn against construction progress certified by an engineer and architect. Ask the builder for the escrow account details. Ask the developer for details of the designated RERA account and verify available project disclosures through KRERA.

5. Land Title Verification

Before anything else, the title of the land on which the project is being built must be clear. Verify:

  • The builder's ownership or development rights through the registered development agreement

  • Encumbrance Certificate for the land at kaverionline.karnataka.gov.in

  • BBMP or BDA building plan approval number

  • Whether the land is subject to any litigation, government acquisition notification, or forest reservation

A project built on disputed land, or where the builder ensures the developer has valid ownership or legally enforceable development rights supported by registered documents.

What Does "Builder Licence Check" Actually Mean in India?

Unlike the US or UK, India does not have a single national or state "contractor licence" that verifies a builder's credentials in the way a trade licence does. The verification equivalent in India is a combination of:

  • RERA registration  the builder must be registered as a promoter with the state RERA authority for each project

  • MCA company status  the builder entity must be an active, compliant company or LLP

  • GST registration  verifiable at the GST portal for commercial credibility

  • Past project delivery record  verifiable through RERA's completed projects database and physical site visits

  • Building plan approvals  sanctioned by BBMP, BDA, or BMRDA for the specific project

None of these is a "licence" in the traditional trade sense; collectively, they constitute the equivalent verification standard before any booking.

For Karnataka projects specifically, the KRERA portal at rera.karnataka.gov.in is the first and most important check  it is the statutory registration that allows a builder to advertise and sell.

What Should You Do If You Are Already Invested in a Stalled Project?

If you have paid a booking amount or taken a home loan for a project that has stalled or been linked to fraud allegations:

  • Do not stop EMI payments unilaterally; contact your bank to understand your rights under the loan agreement first

  • File a complaint with KRERA at rera.karnataka.gov.in under Section 31. KRERA can direct the promoter to rectify defaults and award interest for delays

  • If your project is part of an ongoing CBI investigation, monitor official CBI updates and seek legal advice regarding your remedies.

  • Engage a property lawyer to assess whether the booking agreement contains a valid refund clause and how to invoke it

  • Join the Residents' Welfare Association or Buyers' Association of the specific project; collective action before KRERA and courts is consistently more effective than individual complaints

The path to justice is uncertain. Real estate disputes in India often drag on for years, and when developers declare bankruptcy, buyers are left with little more than half-built structures and mounting debt. Still, with Supreme Court oversight and the CBI's aggressive pursuit of cases, there is a growing perception that accountability in India's real estate sector may finally be shifting.
