OC vs CC: Meaning, Legal Difference and Why Both Matter

Why This Confusion Exists
When buyers and brokers in Bangalore say "OC and CC," they typically mean one of two different things depending on context.
In the building approval system administered by the Greater Bengaluru Authority, CC formally means Commencement Certificate, the document that authorises the owner to begin construction after the building plan is sanctioned. A Building Commencement Certificate is an official document issued by the local planning authority confirming the plan has been approved, and construction may legally start. In Bengaluru, the CC is issued by the Town Planning Section of the Greater Bengaluru Authority, which took over from BBMP in October 2025.
In the property sales market, however, CC is frequently used as shorthand for Completion Certificate a different document issued after construction is finished, confirming the building matches the sanctioned plan. A Completion Certificate is issued by the local authority certifying that the construction of a building has been completed as per the approved building plan, confirming the construction matches the sanctioned plan in terms of layout, number of floors, and setbacks.

The Three Certificates: In the Correct Legal Sequence
Stage 1 Building Plan Sanction
Before any construction begins, the owner or developer must submit architectural drawings to the GBA/BBMP for approval. Once approved, the authority issues a Building Plan Sanction, the permission to build. This is not a CC. It is the document that precedes the CC.
Stage 2 Commencement Certificate (CC)
A Commencement Certificate is permission to start building it is separate from the building plan sanction. The CC application is submitted online via the BPAS portal by a BBMP-registered architect, not directly by the owner.
The CC confirms that the foundation and site preparation meet the sanctioned specifications and that construction may proceed. It is issued at the start of construction, after the building plan sanction but before any significant work is underway.
Any structural work undertaken without securing the necessary statutory clearances is deemed unauthorised and legally invalid.
The legal necessity for an independent Commencement Certificate is governed by the specific building bylaws and municipal framework active in the jurisdiction. An Occupancy Certificate cannot be issued for a building constructed without a valid CC, and any unauthorised portions may be ordered demolished.
Stage 3 Completion Certificate
After construction is complete, a Completion Certificate may be obtained confirming that the building as constructed matches the sanctioned plan. A Completion Certificate confirms the building meets safety and construction standards and is issued by local authorities after construction is completed; however, a CC does NOT mean the property is ready to live in. That is where the OC comes in.
Stage 4 Occupancy Certificate (OC)
The OC is the final and most critical document in the sequence. An Occupancy Certificate in Bangalore is an official document issued by BBMP or GBA certifying that a building is legally safe to live in. Without OC, occupying a flat is illegal under the Karnataka Municipal Corporations Act and RERA 2016. Builders must obtain OC before handing over possession.
The OC confirms that the building is built according to the approved plan, meets safety standards, has passed required inspections, and has proper water, electricity, drainage, and fire approvals.

What the OC Covers: The Inspection Points
Before issuing an OC, the GBA/BBMP inspects the building against the following parameters. A failure on any of these can result in the OC being withheld:
Structural compliance: The built structure foundation, columns, beams, slabs must match the sanctioned structural drawings. Additional floors, extended balconies, or modified layouts that were not in the sanctioned plan will prevent OC issuance.
Fire safety systems: The building must have operational fire suppression systems, fire exits, emergency lighting, fire alarm panels, and a fire NOC from the Karnataka State Fire and Emergency Services, all as per the applicable fire safety norms for the building's height and occupancy type.
Water and sewage connections: The building must have approved BWSSB connections or an approved alternative water source. The drainage and sewage systems must be connected to municipal infrastructure or a certified treatment system.
Rainwater harvesting: Karnataka law mandates rainwater harvesting structures for buildings above a certain size. Absence of an operational RWH system is grounds for OC refusal.
Setback compliance: The building must observe the minimum setback from all boundaries, roads, and adjacent structures as sanctioned. Encroachments on setbacks block OC issuance.
Electrical clearance: BESCOM must have issued the electrical connection to the building with the correct sanctioned load.
Legal Consequences of Occupying Without an OC
Occupying a building without an occupancy certificate is not permitted under the Karnataka Municipal Corporations Act, 1976. The corporation can act against unauthorised occupation. RERA places the duty to obtain and share the OC squarely on the promoter for registered projects. BBMP has also moved to tighten the link between these certificates and ownership transfer, pressing builders to produce completion and occupancy certificates before flats change hands.
The specific consequences:
A-Khata cannot be issued. BBMP requires a valid OC before issuing an A-Khata. A building without one is typically assigned B-Khata status instead. Without an A-Khata, paying tax in your name, registering a resale, and raising a clean loan all become harder.
Home loan disbursement may be blocked. Most banks and housing finance companies treat the OC as a mandatory condition for final disbursement of the home loan. A buyer purchasing a resale flat without OC will find that their financier either refuses the loan or significantly limits the loan-to-value ratio.
RERA complaint is maintainable. Under the Real Estate (Regulation and Development) Act, 2016, a builder who hands over possession of a flat without the OC violates the Act. A buyer may file a complaint with K-RERA at rera.karnataka.gov.in to compel the developer to obtain the OC.
Utilities may be disconnected. Nearly 10,000 buildings in Bengaluru, including 50% of apartments built after the Karnataka government introduced Transfer of Development Rights, lack valid OCs. The Supreme Court's 2024 order required utility connections to be linked to OC status, meaning buildings without OC can face BESCOM and BWSSB connection issues.
What Buyers Must Ask Before Accepting Possession
Before accepting possession of any flat or apartment in Bengaluru, verify the following in writing from the developer:
The Commencement Certificate number and issuing authority. The Occupancy Certificate number and date of issue. If the OC has not yet been issued a specific written commitment with a date and the specific reason for the pending OC. A copy of the KSBC fire NOC is included within the OC process.
Do not accept representations that the "OC is in process" or "will be obtained in a few months" without a written, time-bound commitment enforceable under RERA. An OC that is "in process" at possession means you are legally occupying an uncertified building, and the builder has transferred the risk of non-compliance to you.
