House Lease Agreement: Format, Template and Clauses 2026

Learn what a house lease agreement means, the format to use in Karnataka, key clauses, stamp duty, a ready template, and a room rent agreement sample for 2026.

Quick Summary (TL; DR)

  • A house lease agreement is a legal contract between a landlord and a tenant for renting a residential property, such as a flat, an independent house, or a room

  • The most common format in Bengaluru is the 11-month lease, with stamp duty capped at ₹500, registration not mandatory but strongly recommended

  • Key clauses: rent, deposit, lock-in, maintenance, notice period, permitted use, and pet or sub-let rules

  • For leases above 11 months, registration at the Sub-Registrar's Office is mandatory under Section 17 of the Registration Act

  • Room rent agreements follow the same structure as house leases, just scoped to a single room or portion of the property

What Is a House Lease Agreement?

Meaning, Purpose and Legal Basis

A house lease agreement  also called a house rental agreement, home rental agreement, or residential tenancy agreement  is a legally binding contract between a property owner (landlord or lessor) and a person renting the property (tenant or lessee).

It sets out the terms under which the tenant may live in the property: how long, how much, what is included, and what happens when either party wants to leave.

Without a written agreement, neither landlord nor tenant has any legal protection.

Oral agreements are unenforceable in most practical situations. If a landlord or tenant behaves unfairly, withholding the deposit, demanding sudden rent hikes, refusing to vacate, the only document that protects you is the one you signed.

The Transfer of Property Act, 1882 (Sections 105–117) governs lease agreements in India. In Karnataka, residential tenancies are also subject to provisions under the Karnataka Rent Control Act for older properties, and the general Registration Act, 1908 for registration obligations.

For Example:

You found a house. You agreed on the rent. The landlord seems reasonable. Now comes the agreement.

Most tenants in Bengaluru sign whatever the owner hands them. A two-page document with no deposit refund clause. No maintenance terms. No lock-in. No notice period.

Three months later, the landlord asks them to vacate with seven days' notice.

A house lease agreement done right prevents exactly that. This guide covers the meaning, format, clauses, stamp duty, and ready-reference templates for house and room rental agreements in Karnataka.

How Is a House Lease Agreement Different from Other Property Documents?

Lease vs Licence vs Sale  What You Are Actually Signing

In India, the terms "lease agreement", "rental agreement", and "leave and licence" are often used interchangeably. They are not the same document, and the distinction matters legally.

Document

What It Is

Who It Protects

House Lease Agreement

Transfer of right to enjoy the property for a fixed term

Tenant has stronger rights; difficult for landlord to evict

Leave and Licence Agreement

Licence to occupy  no transfer of interest

Landlord-friendly; easier to revoke

Sale Deed

Permanent ownership transfer

Buyer

Gift Deed

Transfer without payment

Most residential agreements in Bengaluru are Leave and Licence agreements in substance, even when called "lease agreements" on paper.

If you want stronger tenancy protection, ask for a lease. If you are a landlord who needs flexibility to recover the property, a leave and licence is better. A lawyer can advise what is appropriate for your situation.

For this guide, we use "house lease agreement" and "house rental agreement" as practical equivalents  the clauses and format are the same for most residential agreements in Karnataka.

What Are the Different Types of House Rental Agreements?

Full House, Apartment, Independent House, and Room

Not every residential rental agreement looks the same. The scope of the property being rented determines which type of agreement you need.

1. House Rental Agreement (Independent House / Villa) Used when an entire independent house or villa is rented. This is the most comprehensive form  covers the structure, land around it, garden, parking, and all amenities. Maintenance responsibilities are broader since there is no housing society managing common areas.

2. Apartment / Flat Rental Agreement Used when a flat in a residential complex is rented. Common in Bengaluru's gated societies in Whitefield, Sarjapur Road, Marathahalli, and Koramangala. Includes society maintenance charges, parking allocation, amenity access rules, and compliance with society bye-laws.

3. Room Rent Agreement / Room Lease Agreement Used when a single room or a set of rooms within a larger house is rented. The tenant shares common areas (kitchen, bathroom, corridors) with other occupants or the owner. This format requires extra clarity on shared space rules.

4. House Rent Agreement Letter (Simple Format) A shorter, simpler version used for informal or short-duration arrangements. Typically one to two pages. Not advisable for deposits above ₹50,000 or for tenures above 3 months  the absence of detailed clauses creates risk.

5. 11-Month House Rental Agreement The most common format in Bengaluru. Structured for 11 months specifically to keep the stamp duty capped at ₹500 and avoid mandatory registration. Usually renewed annually.

What Clauses Must a House Lease Agreement Include?

The Clauses That Protect Both Landlord and Tenant

Whether it is a house rental agreement template for a 2BHK in Indiranagar or a simple room rent agreement form in a paying guest property, these clauses are non-negotiable.

1. Party Details Full legal names, current addresses, and Aadhaar or PAN references for both landlord and tenant. For companies renting staff accommodation, include the company's CIN.

2. Property Description Complete address, flat number, floor, built-up area, and amenities included  parking, lift access, generator backup, terrace rights. What is and is not included must be written explicitly.

3. Lease Term Start date and end date. For 11-month agreements: specify the exact 11-month period. For longer leases: specify renewal terms and notice required for non-renewal.

4. Monthly Rent Amount in ₹, due date (typically 1st or 5th of each month), mode of payment (NEFT, UPI, cheque), and grace period if any. Late payment penalty if applicable.

5. Rent Escalation Percentage increase on renewal. Usually 5–10% per annum. Without this clause, tenants may resist any increase and landlords have no written basis to demand one.

6. Security Deposit Amount in ₹, refund timeline after vacating (specify days  15, 30, or 60 days), and permissible deductions (damages beyond normal wear and tear, unpaid utility bills). This is the most disputed clause in residential agreements  be specific.

7. Maintenance and Utilities Who pays society maintenance charges? Who pays for minor repairs (taps, bulbs, door handles)? Who handles major structural repairs? Who pays for BESCOM, BWSSB, gas, and internet?

8. Lock-in Period Minimum period either party is committed to the agreement. If the tenant vacates before this, they forfeit part of the deposit or pay equivalent rent. If the landlord asks the tenant to leave early, they must compensate. Usually, 6–11 months for residential leases.

9. Notice Period: How much advance notice is required from either party to end the tenancy after the lock-in? Usually 1–2 months. Without this clause, landlords and tenants can demand immediate exits, causing significant hardship.

10. Permitted Use The property is for residential use only. No commercial activity, no sub-letting without consent, no use for purposes that disturb neighbours.

11. Pet Policy: Pets allowed or not. If allowed, any conditions breed restrictions, damage liability, and cleaning obligations. The absence of this clause leads to constant disputes in apartment complexes.

12. Sub-letting Can the tenant sub-let or share the flat? Usually not without landlord's written consent.

13. Property Condition on Handover Current condition of walls, fittings, appliances, and fixtures at the time of handing over. Ideally, a handover checklist is signed by both parties so the exit condition is measured against this baseline.

14. Termination Clause Conditions under which either party can terminate early  non-payment of rent, violation of society rules, illegal activity. Specifying breach conditions avoids disputes about what constitutes a valid reason to exit.

15. Dispute Resolution City of jurisdiction for any legal proceedings. Bengaluru courts for Bengaluru properties.

What Does a Room Rent Agreement Look Like?

Room Lease Agreement Template for Single-Room Rentals

A room rent agreement, also called a room for rent agreement form or a lease room agreement template, applies when only one room within a larger property is rented. The tenant shares common areas with the owner or other tenants.

This format is common in Bengaluru for:

  • Single working professionals renting rooms in residential houses in areas like HSR Layout, BTM Layout, Hennur, and Yelahanka

  • Students renting rooms near educational institutions

  • PG-type arrangements where multiple rooms are rented separately

A room rent agreement needs one extra section that a full house agreement does not: shared space rules.

Additional Section

What It Must Specify

Room Description

Which room  dimensions, floor, facing direction, window, attached/shared bathroom

Shared Spaces

Kitchen, drawing room, bathroom, balcony, terrace  what is accessible and when

House Rules

Cooking timings, visitor policy, noise restrictions, curfew if any

Co-tenant Rules

Who else lives in the house; tenant's obligations towards co-tenants or owner

Common Utilities

How BESCOM and water bills are split  equally or by usage

Common Area Maintenance

Who cleans shared spaces and how often

Guest Policy

Overnight guests  permitted or not, and under what conditions

The rent, deposit, lock-in, notice period, and termination clauses follow the same structure as the full house rental agreement template above  just scoped to the room.

A room rent agreement printed on ₹100 stamp paper and signed by both parties is better than nothing. But a properly stamped document is far stronger legally.

What Stamp Duty Applies to House Lease Agreements in Karnataka?

How Much You Pay and Why the 11-Month Format Exists (as of March 2026)

Stamp duty on house rental agreements in Karnataka is calculated under the Karnataka Stamp Act, 1957  Schedule I, Article 35.

For residential leases:

Lease Duration

Stamp Duty

Up to 11 months

1% of annual rent + deposit  capped at ₹500

12 months to 5 years

2% of average annual rent + deposit  no cap

5 years to 10 years

4% of average annual rent + deposit

Above 10 years

Higher rates; treated differently

That ₹500 cap is why almost every landlord in Bengaluru insists on an 11-month agreement.

On a house with ₹30,000 monthly rent and ₹1,80,000 deposit:

  • Annual rent: ₹3,60,000

  • Stamp duty at 1%: ₹5,400  but capped at ₹500

  • Actual stamp duty: ₹500

If the same agreement were for 12 months or more:

  • Stamp duty: 2% of (₹3,60,000 + ₹1,80,000) = 2% of ₹5,40,000 = ₹10,800

Stamp duty is paid through e-stamp paper purchased at SHCIL (shcilestamp.com) or authorised stamp vendors.

Verify current rates at igr.karnataka.gov.in before executing any rental agreement. Rates are as of March 2026.

When Does a House Rental Agreement Need to Be Registered?

Registration Rules  When It Is Optional and When It Is Mandatory

Under Section 17 of the Registration Act, 1908, leases of immovable property for a term exceeding 11 months must be compulsorily registered.

Lease Duration

Registration Required?

Up to 11 months

Not mandatory  optional

12 months and above

Mandatory

Long-term leases  5 years or more

Mandatory; higher stamp duty applies

An unregistered agreement for 12 months or more cannot be used as primary evidence in court.

Even for 11-month agreements, registration is strongly recommended if:

  • The security deposit is ₹1 lakh or more

  • The monthly rent is above ₹50,000

  • The property has had prior ownership disputes

  • The tenant is an NRI or out-of-station owner relying on the document

Registration is done at the Sub-Registrar's Office (SRO) where the property is located. In Bengaluru, find your SRO at kaverionline.karnataka.gov.in.

Registration fee as of March 2026: 2% of the lease value (revised August 31, 2025  was 1% earlier). Both landlord and tenant must be present with two witnesses and valid identity documents.

What About the Word and PDF Format of House Rental Agreements?

Does the File Format Matter Legally?

Many tenants and landlords ask whether a house rental agreement in Word format or house rental agreement in PDF format is legally valid.

The file format does not determine legal validity. The stamp paper does.

A house rental agreement can be drafted in Microsoft Word, converted to PDF, or typed on any computer. What makes it legally valid is:

  • Being printed on e-stamp paper of the correct value (₹500 for 11-month residential agreements in Karnataka)

  • Being signed by both parties and two witnesses

  • Being registered at the SRO if the lease term exceeds 11 months

You can prepare the agreement draft in Word or PDF, print it on e-stamp paper, sign it, and it becomes a legally enforceable document. The Word or PDF file itself has no legal standing  it is just a draft until it is stamped and signed.

A PDF of your rental agreement stored on your phone is useful for reference. The original stamped and signed document is what you produce in court.

Frequently Asked Questions

A house lease agreement is a legally binding contract between a property owner and a tenant for renting a residential property flat, independent house, or room for a specified period in exchange for rent and a deposit. It defines the rights and obligations of both parties, including rent, deposit, maintenance, lock-in, notice period, and permitted use. Without a written agreement, neither party has any legally enforceable protection.

In everyday usage, these terms mean the same thing. Technically, a lease creates a greater interest in the property the tenant has stronger rights to occupy. A rental or leave and licence is more flexible for the landlord and easier to revoke. Most residential agreements in Bengaluru are leave and licence agreements in substance, even when labelled as lease agreements. For most practical purposes, the format and clauses are identical.

An 11-month rental agreement is a house lease agreement structured for exactly 11 months, specifically to keep the stamp duty capped at ₹500 under Karnataka law and avoid mandatory registration under Section 17 of the Registration Act. It is the most common residential agreement format in Bengaluru. On expiry, it is usually renewed with a fresh agreement for another 11 months, often with a 5–10% rent increase.

For leases up to 11 months, stamp duty is 1% of annual rent plus deposit, capped at ₹500 for residential properties. For leases of 12 months to 5 years, stamp duty is 2% of average annual rent plus deposit with no cap. Stamp duty is paid via e-stamp paper from SHCIL or authorised vendors. Verify current rates at igr.karnataka.gov.in before executing the agreement.

Registration is mandatory for leases of 12 months or more under Section 17 of the Registration Act, 1908. For 11-month agreements, registration is optional but strongly recommended if the deposit is ₹1 lakh or more. An unregistered agreement for a term above 11 months cannot be used as primary evidence in court. Registration is done at the jurisdictional Sub-Registrar's Office.

A room rent agreement or room lease agreement is a house rental agreement scoped to a single room or a portion of a property. The tenant typically shares common areas, the kitchen, bathroom, and drawing room with the owner or other tenants. In addition to standard rental clauses, a room rent agreement should specify shared space access rules, house rules, guest policy, and how common utility bills are split.

An agreement on plain paper without a proper stamp duty is legally deficient. It can be impounded if produced in court and will be treated as evidence only after the stamp duty shortfall and penalty are paid through adjudication. Always print the agreement on e-stamp paper of the correct denomination from SHCIL or an authorised stamp vendor. The Word or PDF draft has no legal standing on its own.

A security deposit is an advance amount, typically 2 to 3 months' rent for residential properties in Bengaluru, paid by the tenant to the landlord as financial security against default or damage. The agreement must specify the refund timeline (usually 15–60 days after vacating) and list permissible deductions (unpaid bills, damage beyond normal wear and tear). Without a written refund clause, landlords have no set deadline to return the deposit.

A complete house rental agreement template must include party details with Aadhaar references, full property description, lease term, monthly rent and due date, escalation formula, security deposit and refund terms, maintenance split between landlord and tenant, utility payment responsibility, permitted use, pet policy, sub-letting rules, lock-in period with penalty for early exit, notice period, property handover checklist, termination conditions, and dispute resolution clause with city jurisdiction.

The notice period is the advance warning either party must give before ending the tenancy after the lock-in period expires. For residential properties in Bengaluru, notice periods are typically 1 to 2 months. Without this clause, a landlord can demand immediate vacation and a tenant can leave overnight leaving either party without time to find alternative arrangements.
